Terms of agreement

1. Everything must be paid for in FULL within 30 minutes of the close of the Auction regardless of when it’s picked up.

​2.  Everything will be sold “AS IS, WHERE IS”, with NO GUARANTEES of any kind, regardless of statement of condition made from the auction block.  Buyers shall rely entirely on their own inspection and information.

3. Every effort is made to “guard” merchandise throughout the auction; however, the bidder becomes solely responsible for all items purchased  by him immediately following his winning bid.  Therefore, he is advised to further guard his items at his own discretion.

 4. The Bidder is responsible for knowing which item he is bidding on.  If he is unsure, he should inquire or not bid.  When you become the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder.  Auctioneer will not honor “mistakes.”

 5.  The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client, the seller.  The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions or adverse comments he feels are not in the best interest of the seller.

6. The auctioneer’s decision is final & all announcements by Auctioneer take precedence over printed materials.  Buyer agrees, upon registration to bid, to the terms and conditions of this auction.

  • We do not ship items.  If you require logistics, it is your responsibility.

  • Titled Vehicle Titles will be mailed via USPS Certified Mail (you must sign for them) 14 BUSINESS DAYS following the auction.

  • Please read descriptions for title information.  Additional information will be provided up until auction start.

  • LOAD OUT: until 7:00 p.m. on Saturday, May 2nd and from 9-2 on Sunday, May 3rd.

  • General Premium Amounts: 13% BUYERS PREMIUM , 18% BUYERS PREMIUM on most Online Auctions, 3% Cash or Check Discount May 2, 2015 – 3% Onsite Buyers Premium; 13% Buyers Premium Online; 3% CASH OR CHECK DISCOUNT ONLINE TERMS & CONDITIONS Everything will be sold AS IS, WHERE IS, with NO WARRANTY or Guarantee implied or expressed.   Auctioneer makes no representation that any of the lots listed conform to any safety, pollution standard, regulation or law.  United Auctioneers will not be responsible and cannot be held liable for omissions and errors in condition or description of any lot.  Auctioneer makes no representation that any lot is fit for any particular purpose, are merchantable, are of any particular age, year of manufacture, able to be financed, make, model, or condition.

    Bidder shall rely entirely on their own research, viewing of lots, and bidder is solely responsible to inspect, determine the value, condition, quantity of any and all lots.  United Auctioneers is not responsible for any failures in internet service or power outages that cause any bids to be missed during, or at the closing of any lot.  United Auctioneers for any reason and at any time before or during an auction may pull any lots, cancel an auction, reject any bid at our sole discretion.  All lots are available for inspection prior to the auction by appointment only by calling (254)-289-3216.  Lots may be viewed DURING the online auction by appointment only by calling (254)-289-3216.  When bidder places a bid it constitutes a binding contract between the bidder and seller that cannot be retracted or rescinded if the bid is accepted.  It is illegal for the winning bidder to not pay for the lots in which they were determined to be the successful high bidder, prosecution may result for failure to pay.  Bidders are responsible for all bids placed under their bidding number.  Successful high bidder will be furnished with an electronic invoice at the end of the auction and will receive an electronic receipt once full payment is made.  Invoices and receipts will be sent to email of successful bidder, bidder may be notified via phone call by auctioneer if necessary.  Payments for purchases can only be made via CASHIER’S CHECK, MONEY ORDER, or WIRE TRANSFER, and must be made within 4 (four) business days of auction closing.  Payment must be made in full and monies cleared the bank prior to merchandise / any lot being picked up.  All payments must be made to: United Auctioneers unless otherwise noted.  All payments must be drawn on a U.S. bank and in U.S. currency only!  Taxes will be applied according to Texas state law.  Failure to receive an invoice does not relieve bidder of their responsibility to pay for the merchandise set forth herein.  Auctioneer reserves the right to ban any bidder for any reason at auctioneer’s sole discretion!  Auctioneers decision is final regarding all matters pertaining to any online auction by United Auctioneers.  Merchandise / lots / property becomes the sole and full responsibility of the successful bidder, and bidder assumes all risk of loss and damage to such until removed from sale site(s).  All sales are final!  United Auctioneers does not ship or transport or provide any equipment or manpower to remove any lots from sale site, it is up to successful bidder to make all arrangements for pick-up, loading and transport of any and all lots/items/property.   Auctioneer will meet your shipper at confirmed date and time at sale site for pick-up and delivery of your merchandise.  Call (254)289-3216 to make arrangements for pick-up.  Items are located at the address provided on your invoice.  Items must be picked up no later than 10 (ten) days after the end of any auction, there will be a $35.00 per day storage fee after 10 days.  There is a 15% BUYER’S PREMIUM for ONLINE Buyers/BIDDERS!  Bidder accepts responsibility for and agrees to indemnify, defend, and hold harmless each Seller/Owner and Auctioneer, their employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents, and representatives, from and against any and all claims, losses, damages, liabilities, judgements, fees, costs, and expenses (including reasonable attorney fees and expenses) related to, arising from or associated with the use of the site and bidding process by the bidder, his agents, representatives, personal injuries or property damage incurred on the sale premises or during removal and transport of any auction lots/item/property any breach or violation by bidder of this agreement or any use by the bidder of the site.  By using this site bidder accepts all the terms and conditions set forth herein.  All Texas auctioneers are regulated and licensed by The Texas Department of Licensing and Regulation.  Licensing with the Department does not imply approval or endorsement by The State of Texas.  Complaints and Compliments may be directed to The Department at 920 Colorado drive Austin, Texas 78701, (512)463-6599.  Auctioneer – Randall Kirkes license number 17531.
